TermsThese terms govern your use of OurCodeMarket. They apply whether you are browsing, buying or selling, and they sit above the other policies on this site. Where a specific policy covers a subject in more detail, that policy applies to that subject and these terms apply to everything else.
By creating an account or using the site, you accept these terms. If you do not accept them, do not use the site.
OurCodeMarket is a marketplace. Items are created and licensed by independent sellers, not by us. We handle the platform, the payment and the licensing infrastructure. We do not write the items and we do not warrant them.
We are a marketplace
Items are made by independent sellers. We provide the platform, not the code.
Your account is yours
Keep your credentials secure. Activity under your account is treated as yours.
Licensed, not sold
You buy permission to use an item on stated terms, never ownership of it.
Liability is limited
Our responsibility is capped, and set out plainly rather than buried.
01 Who we are
OurCodeMarket is operated by BonViser Digital and is part of Domzivo. In these terms, "we", "us" and "our" mean the operator; "you" means the person or organisation using the site.
These terms incorporate the privacy policy, licence terms, refund policy, download policy, seller terms, payout policy, item support policy, free items policy and copyright and DMCA policy.
02 Eligibility
To use OurCodeMarket you must be at least 18, or the age of majority where you live, and legally able to enter a binding contract. If you are using the site for an organisation, you confirm you are authorised to bind it to these terms.
You may not use the site if you are barred from doing so under any applicable law or sanctions regime, or if we have previously closed your account.
03 Your account
- Give accurate registration details and keep them current
- Keep your password and any API keys confidential
- Tell us promptly if you believe your account has been accessed by someone else
- Sharing an account, or letting anyone else use yours
- Holding multiple accounts to evade a limit, a suspension or a policy
- Registering on someone else's behalf without their authority
Activity under your account is treated as yours. You are responsible for it, including purchases, unless and until you tell us the account has been compromised.
04 What OurCodeMarket is, and is not
We operate a marketplace where independent sellers list and license their work. We review items before publication, process payments, issue licences and serve downloads.
We do not author the items. A seller is not our employee, agent or partner, and reviewing an item does not make us responsible for it, endorse it, or warrant that it is fit for what you intend.
We act as merchant of record for the transaction, which is why refunds and disputes come to us rather than to the seller's bank. That does not make us the author of the code.
05 Buying
Buying an item grants you a licence to use it on the terms stated on that item's page and in the licence terms. You never acquire ownership of the item itself.
- Prices are shown in US dollars unless stated otherwise
- Taxes required in your country may be added at checkout
- A sale completes when payment clears and the licence is issued
- Refunds are governed by the refund policy, including a 14 day window
We may correct a price shown in obvious error, and may cancel and refund an order placed at such a price. We may refuse or cancel any order, including where we suspect fraud.
06 Selling
Selling is subject to approval and to the seller terms, which set out what you may list, your obligations to buyers, and how you are paid. The payout policy covers the money.
You keep the copyright in what you publish. What you grant us is a licence to display and distribute it through the platform.
07 Acceptable use
You may not:
- Break any law, or infringe anyone's rights, through your use of the site
- Upload malware, or anything designed to damage or gain unauthorised access to a system
- Probe, scan or test the security of the site, or circumvent any access control or licence check
- Scrape, crawl or bulk-download the site or its items, or use automated tools to collect free items
- Interfere with the operation of the site, including by overloading it
- Resell, sublicense or redistribute items in breach of their licence
- Manipulate ratings, reviews, comments or sales figures
- Impersonate anyone, or misrepresent your association with anyone
- Harass, abuse or threaten other users or our staff
Security researchers acting in good faith should contact us before testing anything, and we will work with you.
08 Content you post
Comments, reviews, store descriptions and anything else you post remain yours. By posting, you grant us a non-exclusive, worldwide, royalty-free licence to display, reproduce and distribute that content in connection with the site.
You are responsible for what you post, and confirm you have the right to post it. Do not post confidential information, credentials, purchase codes, or anyone's personal details.
We may remove content that breaches these terms, and we moderate reviews and comments. Reviews may only be left by buyers who own the item. We do not remove a review because a seller dislikes it.
09 Intellectual property
The OurCodeMarket name, logo, site design, code, copy and documentation belong to us. Nothing in these terms grants you a right to use our branding.
Items belong to their sellers. Your rights in an item come from its licence and nothing else. To report infringement, see the copyright and DMCA policy.
10 Availability and changes to the service
We aim to keep the site available, but we do not guarantee uninterrupted access. Maintenance, incidents and problems at providers happen.
We may change, suspend or discontinue any part of the service, including features, categories and pricing structures. Where a change materially affects sellers, we will give notice. Licences already issued are not affected by a change to the platform.
11 Disclaimers
The site and everything on it are provided as is and as available, without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement, to the fullest extent the law allows.
We do not warrant that items are error free, secure, suitable for your purpose, compatible with your environment, or that they will meet your requirements. Review is a quality gate, not a guarantee.
You are responsible for evaluating an item before you rely on it, for testing it, for your own backups, and for the security of the systems you install it on.
12 Limitation of liability
To the fullest extent permitted by law:
- We are not liable for indirect, incidental, special or consequential loss
- We are not liable for lost profits, lost revenue, lost data, lost goodwill, or business interruption
- We are not liable for the acts or omissions of sellers or buyers, or for disputes between them
- We are not liable for loss arising from your failure to keep credentials secure, or from payout details you entered incorrectly
Our total liability to you for any claim, whatever its basis, is limited to the amount you paid us in the three months before the event giving rise to it, or $100, whichever is greater.
Nothing here excludes liability that cannot lawfully be excluded, such as for fraud or for death or personal injury caused by negligence. Some jurisdictions do not allow certain exclusions, in which case those exclusions apply only so far as the law permits.
13 Indemnity
You agree to indemnify us against claims, losses, liabilities and reasonable costs arising from your use of the site, your breach of these terms or any policy, content you post, items you publish, or your infringement of anyone's rights.
14 Suspension and termination
You may close your account at any time. We may suspend or close an account where these terms or a policy have been breached, where we are required to by law, or where activity presents a risk to other users or to us. Serious breaches may be actioned immediately.
On closure, licences you hold remain valid and we will continue serving your downloads, unless the account was closed for fraud, chargeback abuse, or breach of the licence terms, in which case access may be withdrawn.
Cleared seller earnings remain payable, subject to the hold period and outstanding refunds. The sections on liability, indemnity and intellectual property survive termination.
15 Governing law and disputes
These terms are governed by the laws of the Federal Republic of Nigeria, and the courts of Nigeria have jurisdiction, without affecting any mandatory consumer rights you have where you live.
Before any formal step, please raise the matter with us through a support ticket. Nearly everything is resolved there, and it is faster for both of us.
16 General
If any provision of these terms is found unenforceable, the rest continues in force. Our not enforcing a provision on one occasion is not a waiver of it.
You may not transfer your rights under these terms without our consent. We may transfer ours as part of a reorganisation or sale of the business.
These terms, with the policies they incorporate, are the entire agreement between us on this subject.
17 Changes to these terms
We may update these terms. The date at the top of this page shows when they last changed, and material changes will be announced on the blog and, where they affect sellers, directly.
Continuing to use the site after a change means you accept it. Licences already issued and commission rates already recorded are never changed retrospectively.
